These Terms and Conditions (“Terms”) govern your engagement with our services. By accessing or using our services, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety.

Skill Sync provides education and admissions consultancy services to individuals seeking to study in Australia. Our consultancy services are offered to both onshore students (residing within Australia) and offshore students (living outside Australia).

Through our network of partnered and authorised institutions, we assist students in navigating their education pathways and making informed decisions about study options in Australia.

1. Definitions

• "Client" refers to any individual, student, parent or guardian, or organisation that engages Skill Sync Pty Ltd for the provision of its services. • “Services” refers to the education counselling, application support, training facilitation, and any other related services as outlined in the Client Service Agreement. • “Third-Party Provider” refers to any external organisation, partner, or service provider, including but not limited to educational institutions, insurers, accommodation providers, health or travel insurance companies, verification services, courier services, or immigration agents, engaged by Skill Sync Pty Ltd to deliver or facilitate any component of the Services.

2. Scope of Services

• Education Counselling and Course Selection – Providing guidance and advice to assist Clients in selecting suitable courses and institutions based on their academic background, career goals, and personal preferences. • Admission and Enrolment Support – Assisting Clients with the preparation, submission, and management of admission and enrolment applications to educational institutions. • Visa Application Guidance – Offering general information and support in relation to student visa application processes, or, where appropriate, referring Clients to a registered migration agent for specialised immigration advice or assistance. • Communication with Institutions – Liaising with educational institutions on behalf of the Client for matters related to course applications, offers, and enrolment procedures. • Health Insurance and Accommodation Assistance (Optional) – Providing assistance or referrals in arranging Overseas Student Health Cover (OSHC) and accommodation options, where requested by the Client. • Ongoing Support During Study in Australia – Offering continued assistance to • Clients throughout their studies in Australia, including guidance on course progression, compliance with student visa conditions, and other relevant matters. Skill Sync is not a migration agent, and any migration advice will be provided only through registered partners.

3. Accuracy of Information

The Client must ensure that all personal, academic, and financial information, as well as any supporting documentation provided to Skill Sync Pty Ltd is true, complete, and accurate to the best of their knowledge. Skill Sync shall not be held liable for any delays, rejections, or adverse outcomes arising from false, misleading, or incomplete information or documentation supplied by the Client.

4. Fees and Payment

• All applicable service fees are specified in the Client Service Agreement or in the official offer letter issued by the relevant educational institution. The Client must adhere to the payment terms and schedules as agreed with • Skill Sync Pty Ltd, or as stipulated by the institution. No application, lodgement, or related service will proceed until all required payments have been received in full. • By engaging Skill Sync’s Services, the Client acknowledges receipt of the Fee Disclosure Statement and confirms their understanding of all fees payable, whether to Skill Sync directly or to the institution.

5. Subcontracting and Third-party Providers

Skill Sync Pty Ltd may engage third-party providers, including but not limited to educational institutions, health insurance providers, translation services, courier companies, and verification agencies, to deliver or facilitate certain components of the Services. While such third parties are selected with due care, Skill Sync does not assume responsibility or liability for the actions, performance, omissions, or outcomes of any third-party provider. All products, services, or decisions rendered by third parties are subject to their respective terms and conditions. Skill Sync will disclose any material conflict of interest known to it at the time of engagement, but shall not be held liable for any act, error, or omission of a third-party provider.

6. Intellectual Property

All content on our website, marketing materials and documents is owned or licensed by Skill Sync. You may not reproduce, distribute or commercialise our materials without our written permission.

7. Limitation of Liability and Consumer Guarantees

Skill Sync Pty Ltd shall not be liable for: • The rejection or refusal of any application by an educational institution, government authority, or other third-party body; • Any changes to immigration, education, or regulatory policies; • Any losses, damages, or adverse outcomes resulting from decisions or actions outside the reasonable control of Skill Sync. To the maximum extent permitted by law, Skill Sync’s liability for any loss or damage arising in connection with the provision of its Services shall be limited to the fees paid by the Client for the specific Service giving rise to the claim.

8. Force Majeure

Skill Sync Pty Ltd is not liable for delay or failure to perform resulting from events outside our reasonable control, including but not limited to natural disasters, government action, pandemics, strikes or IT outages.

9. Cancellation and Refunds

Cancellations and refunds are subject to Skill Sync’s Refund Policy.

10. Data Protection & Privacy

All personal information collected, stored, and processed by Skill Sync is managed in accordance with our Privacy Policy and the provisions of the Privacy Act 1988 (Cth).

11. Governing Law

These Terms are governed by the laws of Victoria, Australia, and any disputes arising in connection with them will be subject to the exclusive jurisdiction of the courts of Victoria.

12. Client Service Agreement

A detailed Client Service Agreement (CSA) outlining the scope of services, applicable fees, and specific terms of engagement will be issued to the Client by a Skill Sync education consultant prior to the commencement of any services. The CSA must be reviewed, signed, and returned by the Client before Skill Sync proceeds with any application or related advisory work.

Privacy Policy

Skill Sync Pty Ltd is committed to protecting the privacy of all personal information collected in connection with the provision of its services. All personal information is handled in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

1. Information We Collect

Skill Sync Pty Ltd, may collect personal information that is necessary for the provision of its services, including but not limited to: • Personal details: Name, date of birth, contact information, and other identifying information; • Academic information: Educational history, qualifications, and related documentation; • Travel and visa information: Passport details, visa status, and related records; • Financial information: Payment, sponsorship, or funding details relevant to the provision of services; • Communications: Records of correspondence, feedback, or service-related interactions; and • Sensitive information: Health, guardianship, or other sensitive personal information, collected only where relevant and with the Client’s consent. All personal information is collected, stored, and used in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

2. How We Use Your Information

Skill Sync Pty Ltd may use the personal information collected from the Client for the following purposes: • To provide education counselling, course advice, and admission services; • For sending across to educational institutions, registered training organisations (RTOs), and other relevant partners in relation to the Client’s applications and services; • Where applicable, to provide information to a Migration Agents Registration Authority (MARA)–registered migration agent for visa application purposes, noting that Skill Sync does not provide migration advice; • To comply with legal, regulatory, or statutory obligations, including reporting requirements of education or government authorities; and • To send marketing communications or promotional material, where the Client has provided consent, in accordance with the Privacy Act 1988 (Cth) and the Spam Act 2003 (Cth).

3. Disclosure of Information

Skill Sync Pty Ltd may share or disclose personal information collected from the Client to the following parties, where necessary for the provision of services or to comply with legal obligations: • Australian and overseas education providers, including registered training organisations (RTOs), for the purpose of processing applications, enrolments, or related administrative matters; • Health insurance providers, where the Client requests assistance or arrangements relating to Overseas Student Health Cover (OSHC) or other relevant insurance products; • Third-party Migration Agents, where the Client specifically requests Skill Sync to forward their application to a Migration Agents Registration Authority (MARA)–registered migration agent for visa-related purposes; and • Regulatory or government authorities, where disclosure is required or authorised by law, regulation, or a statutory obligation, including reporting requirements of education or immigration authorities.

4. Data Security

Skill Sync Pty Ltd implements secure digital storage systems and restricted access controls to protect personal information from unauthorised access, misuse, disclosure, or loss. All security measures are maintained in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

5. Data Retention & Deletion

We retain client records and personal information for a period of no less than seven (7) years after the end of the engagement, unless a longer retention period is required by law. You may request deletion of personal data, subject to legal and contractual obligations.

6. Cross-Border Transfers

Skill Sync Pty Ltd may transfer personal information to third parties located in other countries, including but not limited to educational institutions and verification service providers. Where such transfers occur, Skill Sync will take reasonable steps to ensure that the overseas recipients handle the personal information in a manner consistent with this Privacy Policy and the requirements of the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

7. Cookies & Tracking

Skill Sync Pty Ltd may use cookies and similar technologies on its website to enhance user experience, analyse site usage, and personalise content. Users may manage their cookie preferences through the website's cookie banner or via their browser settings. Continued use of the website constitutes acceptance of the use of cookies in accordance with this policy.

9. Sensitive Information

Where Skill Sync Pty Ltd collects sensitive information, we will obtain the express consent of the Client. Such information will be handled securely and used only for the stated purpose.

Clients have the right to access and request correction of their personal information under the Privacy Act 1988 (Cth). Requests must be made to: study@skillsync.com.au.

Refund Policy

The purpose of this Refund Policy is to establish a clear, fair, and transparent framework for the handling of refunds for students engaging the services of Skill Sync Pty Ltd, ensuring compliance with applicable laws and contractual obligations.

1. Application Fees

All application and service fees paid to Skill Sync Pty Ltd are non-refundable once an application has been submitted to an educational institution. Refunds may only be considered within the institution’s prescribed grace period or cooling-off period, in accordance with the institution’s rules and applicable law. Once the Service has been delivered and the Confirmation of Enrolment (CoE) has been issued, all fees are final and non-refundable.

2. Institutional Refunds & TPS

All tuition fees paid directly to an educational institution are subject to the refund policy of that institution and any applicable statutory protections, including, where relevant, the Tuition Protection Service (TPS). Skill Sync Pty Ltd may provide assistance to the Client in submitting refund requests; however, the decision to grant or deny any refund lies solely with the educational institution, and Skill Sync has no control over such decisions.

3. Visa Refusal

In the event that a student visa is refused by the Department of Home Affairs: • All service fees paid to Skill Sync Pty Ltd are non-refundable, as the services for which they were charged have already been rendered; and • Any tuition fees paid directly to the educational institution will be subject to the refund policy of that institution and any applicable statutory protections. Skill Sync may assist the Client in submitting refund requests to the institution, but does not influence or control the outcome of such requests.

4. Withdrawal, Deferral or Cancellation

• Withdrawal Before Application Lodgement: If the Client withdraws prior to the submission of an application to an educational institution, a pro-rata refund of fees may be offered in accordance with the Fee Disclosure Statement. • Withdrawal After Application Lodgement: Once an application has been submitted, any refund of fees will be subject to the policies and discretion of the relevant educational institution. • Provider-Initiated Cancellation:​ In the event that an educational institution cancels a Confirmation of Enrolment (CoE) or course, refunds will be handled strictly in accordance with the institution’s refund policy. Skill Sync Pty Ltd will assist the Client in lodging any refund claims, but does not control or guarantee the outcome of such claims.

5. OSHC and Third-Party Products

Any health insurance, accommodation, or other third-party products purchased through Skill Sync Pty Ltd are subject to the terms, conditions, and refund policies of the respective suppliers. Skill Sync may charge and retain a non-refundable administration fee for the facilitation, arrangement, or processing of such products. Skill Sync does not control, guarantee, or influence the refund decisions of the third-party suppliers.

6. Processing Times & Method

Approved refunds will be processed within twenty-one (21) business days from the date of approval. Refunds will be remitted to the original payer unless otherwise agreed in writing. Any applicable bank charges, currency conversion fees, or merchant processing fees may be deducted from the refunded amount.

7. Exceptional Circumstances

Refunds outside the provisions of this Refund Policy may be considered at the sole discretion of Skill Sync Pty Ltd in exceptional circumstances, including but not limited to medical emergencies, documented administrative errors, or other unforeseen events. Any such consideration does not create a binding obligation on Skill Sync to provide a refund.

Complaints Policy

Skill Sync Pty Ltd is committed to providing high-quality services.

If a Client has a complaint regarding our services or wishes to appeal a decision, they are encouraged to follow the procedures outlined below to ensure their concern is addressed in a fair, timely, and transparent manner.

1. Submit your complaint

Clients are requested to submit a written complaint by email to study@skillsync.com.au, providing the following information: • Full name and contact details • Nature and details of the complaint • Any supporting documentation or evidence relevant to the complaint This ensures that Skill Sync Pty Ltd can properly assess and respond to the complaint in accordance with its internal complaints and appeals procedures.

2. Acknowledgement

Skill Sync Pty Ltd will acknowledge receipt of any complaint within three (3) to seven (7) business days of submission. This acknowledgment confirms that the complaint has been received and will be addressed in a timely and transparent manner.

3. Investigation

Skill Sync Pty Ltd will investigate all complaints and endeavour to provide a decision or formal response within fifteen (15) business days of receipt. If it is not possible to provide a response within this timeframe, Skill Sync will notify the Client of the expected date by which the decision or response will be provided.

4. Internal Review

If a Client is dissatisfied with the outcome of a complaint, they may request an internal review by the Principal of Skill Sync Pty Ltd by submitting a written request via email to connect@skillsync.com.au within ten (10) business days of receiving the original decision.

5. Confidentiality and No Retaliation

All complaints submitted to Skill Sync Pty Ltd will be handled in a confidential and professional manner. Clients will not be subject to discrimination, reprisal, or any disadvantage as a result of lodging a complaint.

6. Record-Keeping

Skill Sync Pty Ltd will maintain a complete record of all complaints, including the investigation process, resolution, and any corrective actions taken, for a minimum period of seven (7) years in accordance with applicable legal and regulatory requirements.
